Summary

OrchOps is an independent project created by and for creators. We are currently in private beta by invitation. These terms regulate our relationship with you, based on transparency, responsible data use, and mutual respect.

1. Who is behind OrchOps

OrchOps is a platform created by Orchestrating Operations, an independent project driven by professionals with over 20 years of experience in the conceptualization, creation, and distribution of content on digital platforms.

We come from the same place as many creators: working with real platforms, interpreting incomplete data, testing formats, making mistakes, and learning on the go. OrchOps was born from that experience, with the aim of building a tool that helps better understand content and its evolution, thought out by creators and for creators.

The OrchOps website is publicly accessible, while the use of the platform is currently in a private beta phase, with access limited by invitation. When we refer to “OrchOps”, “we”, or “the platform” in these Terms, we refer to the team responsible for the development and operation of the service.

2. What these terms are for

These Terms regulate access, navigation, and use of the OrchOps website, as well as access to the functionalities and services offered by the platform.

By accessing the website, requesting access, or using OrchOps, you accept these Terms. If you do not agree with them, we ask that you do not use the platform.

Our goal is for you to be clear about what you can expect from OrchOps and what we expect from you as a creator.

3. Usage requirements

To use OrchOps you must meet the following requirements:

  • Be at least 18 years old.
  • Be the legitimate owner of the social media accounts you connect to the platform, or have express and valid authorization to manage them and analyze their data.
  • Provide truthful and updated information when necessary for the operation of the service.
  • Be responsible for maintaining the confidentiality of your access credentials, as well as all activity carried out from your account.

OrchOps is not responsible for access or use of the service by third parties as a result of negligent management of your credentials.

4. Permitted Use and Prohibited Use

OrchOps is designed to help you analyze and understand the performance of your content. By using the service, you agree to do so responsibly and in accordance with these Terms.

Permitted Use

You can use OrchOps to:

  • Analyze the performance of your accounts and content.
  • Organize metrics and data for personal or professional use.
  • Obtain context and insights for decision-making regarding your content strategy.

Prohibited Use

It is not permitted to:

  • Use the service for illicit, fraudulent purposes or purposes that violate third-party rights.
  • Perform scraping, reverse engineering, decompilation, or any attempt to access the code, internal logic, or systems of OrchOps.
  • Attempt to bypass, breach, or compromise the platform's security measures.
  • Use OrchOps in a way that could damage, overload, or negatively affect the service or other users.

In case of detecting use contrary to these Terms, OrchOps may limit, suspend, or cancel access to the service.

5. Platform Access (Invitation Access)

OrchOps is an evolving platform and currently operates under an invitation-only access model. This model allows us to maintain service quality, validate features, and improve the experience of participating creators.

Requesting access does not guarantee immediate entry. We reserve the right to accept, postpone, or reject requests based on technical, operational, or service capacity criteria.

Likewise, we may limit, suspend, or revoke access when necessary for reasons of security, maintenance, or misuse of the platform.

6. Responsible Use of the Service

We want you to use OrchOps as a tool to better understand your content and make decisions with more context. To do this, you agree to use the platform lawfully, responsibly, and consistently with its purpose.

If we detect clearly improper use or use contrary to these Terms, we may adopt the necessary measures to protect the platform and other users.

7. About Data, Metrics, and Insights

OrchOps analyzes information from third-party platforms (such as social networks) and presents it in a structured way to help you interpret patterns, trends, and relevant signals about your content.

You must keep in mind that:

  • Data depends on external sources and their APIs.
  • The availability, scope, or accuracy of data may vary or disappear without prior notice.
  • The insights shown are indicative and based on automated analysis.

OrchOps does not provide professional, financial, commercial, or strategic advisory services. The decisions you make based on the information shown on the platform are always your responsibility.

8. Use of Results

You can use the analysis, metrics, and insights generated by OrchOps for your own analysis, internal organization, or personal or professional presentations.

It is not permitted to redistribute, resell, or commercially exploit the platform, its visualizations, or its internal logic as if it were your own product, nor offer access to third parties without express authorization.

9. Intellectual and Industrial Property

All contents of the OrchOps website and platform —including texts, designs, interfaces, visualizations, software, algorithms, methodologies, brands, and logos— are owned by OrchOps or third parties who have authorized their use.

Access or use of the service does not grant you any ownership rights over such contents, beyond the right of use necessary to utilize the platform in accordance with these Terms.

The reproduction, distribution, transformation, or exploitation of these contents outside the service without prior written authorization is prohibited.

10. Confidentiality

During the use of OrchOps, you may access non-public information, including features in beta phase, internal documentation, advanced configurations, or aggregated data not publicly visible.

You agree not to disclose or use this information for purposes other than the legitimate use of the platform, unless it is information in the public domain or obtained legitimately outside of OrchOps.

11. Personal Data Protection

The processing of your personal data is carried out in accordance with current legislation and as set forth in our Privacy Policy, which details what data we collect, for what purpose it is used, and how you can exercise your rights.

12. Service Availability and Limitation of Liability

We work to ensure that OrchOps is available and functions correctly, but we cannot guarantee uninterrupted or error-free operation.

OrchOps will not be responsible for:

  • Temporary service interruptions due to maintenance, improvements, or causes beyond our control.
  • Changes in third-party platforms that affect the data shown.
  • Damages derived from the use or inability to use the service, within the limits permitted by law.

13. Suspension or Cancellation of Access

We may suspend or cancel your access to OrchOps, temporarily or permanently, if:

  • You breach these Terms.
  • You make use that could damage the platform, other users, or third parties.
  • It is necessary for legal, technical, or security reasons.

Whenever possible, we will try to communicate this to you in advance.

14. Modifications

We reserve the right to modify, update, or replace these Terms and Conditions at any time to adapt them to legal, technical, operational changes, or the evolution of the service.

Updated versions will be published on the website. If the changes are relevant, we will make reasonable efforts to notify you. Continued use of OrchOps after the entry into force of the modifications implies acceptance of the updated terms.

15. Applicable Law and Jurisdiction

These Terms are governed by Spanish legislation. For any conflict that might arise from access or use of the website or the service, both parties submit to the Courts and Tribunals of the city of Madrid, expressly waiving any other jurisdiction that might correspond to them.
